By accessing and using the services provided by XK Interactive ("Company", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
We provide web design, development, branding, digital marketing, AI solutions, photography, video production, and related digital services as described on our website. The specific scope of work for each project will be outlined in a separate project proposal or contract.
A deposit of 50% is required to begin work unless otherwise agreed upon in writing. The remaining balance is due upon project completion, prior to final file delivery. Monthly services are billed at the beginning of each month. Late payments may incur a 1.5% monthly interest charge.
Upon full payment, all custom work product (designs, code, content) created for the client will be transferred to the client. Third-party assets (stock photos, fonts, plugins) remain under their respective licenses. We retain the right to showcase completed work in our portfolio unless otherwise agreed.
Projects include a specified number of revision rounds as outlined in the project proposal. Additional revisions beyond the agreed scope will be billed at our standard hourly rate. Significant scope changes may require a revised proposal and timeline.
We maintain strict confidentiality regarding all client information, business strategies, and proprietary data shared during our engagement. We will not disclose confidential information to third parties without written consent.
Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question. We are not liable for indirect, incidental, or consequential damages.
Either party may terminate a project with 30 days written notice. In the event of termination, the client is responsible for payment of all work completed to date. Deposits are non-refundable once work has commenced.
